Many districts will not let a teacher use a tool with students until a data privacy agreement is signed. The names vary: data processing agreement, student data privacy agreement, vendor addendum. The idea is the same. The district writes down what the vendor may do with student information and what it owes the district in return.
What we offer
We do not have a standing, pre-signed agreement for any particular state or district. What we do is handle the request: if your district needs a signed data processing agreement, a state student-privacy addendum or answers to a vendor-review questionnaire, email the contact address on the data practices page and we will work through it with whoever reviews contracts for you. We have not published a template. We would rather read your district form than push ours.
Terms we can agree to
These match our existing public commitments in the privacy policy and terms, so they are the easy part of any agreement.
| Typical clause | Where we stand |
|---|---|
| Use limited to the service | Student information is used to operate the adaptive learning service and nothing else. |
| No sale, no advertising | We do not sell student data and we do not show advertising or run advertising trackers. |
| Deletion and return | Full account and data deletion on request within 30 days. A copy of the school data, such as rosters and mastery records, is provided on request, and users can export their own records as JSON. |
| Breach notice | Affected account holders are emailed without undue delay after a breach is confirmed. |
| Outside services | The services that handle data for us are listed on the data practices page. |
| Security description | See the security overview for what we can verify. |
Where a district may want more than we have
- A fixed notice deadline. Our public statement has no day count. Some state laws set one for vendors, and a district may want a number in the contract. That is a point to negotiate, not one we have committed to in advance.
- Insurance. We have not published a statement about cyber-liability coverage. If you require it, ask.
- Audit reports. We have no third-party security certification or audit report to hand over.
- A named privacy officer. Requests go to the contact address on the data practices page. We have not designated a separate data protection role.
- A shared data inventory. Some agreements attach a table of every data element collected. We can describe what we collect, as listed in the privacy policy, and complete your table.
- Counsel review. Any agreement is reviewed by counsel before it is signed, ours and yours. Do not assume an email exchange counts.
What a district should expect in one
- A plain statement of what data is collected and for what purpose.
- A promise not to use it for anything else, including advertising or building profiles outside the school purpose.
- Who the subprocessors are, and a process for telling you when that changes.
- Deletion or return of data when the relationship ends, and confirmation that it happened.
- A breach notice process with named contacts.
- Which state law governs and any state-specific terms. See the state pages in this section for New York, California and others.
If you are a single teacher
You usually cannot sign this yourself. Your district technology or privacy office decides, and the best thing you can do is hand them the student data and AI page and the data practices page, and tell us they are coming. If your district already has a vendor list and ClassSense is not on it, ask what it takes to be added before putting students in.
Plain-language summary, not legal advice. Last reviewed October 2026. Laws and regulations change, so have your district's counsel confirm anything you rely on.
Common questions
Does ClassSense have a signed data privacy agreement with my state?
No. We have not signed a state-specific agreement and we are not listed in a state vendor registry. If your district needs one, we will work through it on request.
Where do I send a district contract or questionnaire?
Email the contact address on the data practices page. We handle signed agreements, state addenda and vendor-review questionnaires by request.
How quickly will you notify us of a breach?
Our public commitment is to email affected account holders without undue delay after confirmation. We have not committed to a specific number of days, so if your law or contract requires one, raise it during review.
Can I get my school data back?
Yes. A copy of the school data, such as rosters and mastery records, is provided on request, and users can export their own records as a JSON file.
